Terms of Service

Effective date: 30 March 2026

These Terms of Service (“Terms”) govern your use of the mycourse.work website and platform (the “Service”). The Service is operated by mycourse.work (“we”, “us”, “our”). By accessing or using the Service, you agree to be bound by these Terms.

Eligibility

You must be at least 13 years old (or the minimum age required in your jurisdiction) to use the Service. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these Terms.

Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to notify us promptly of any unauthorised access or use.

Use of the Service

Permitted use

You may use the Service to create, manage, deliver, and take training courses in accordance with these Terms and any applicable plan or subscription.

Prohibited conduct

You agree not to:

Content and intellectual property

Your content

You retain ownership of any course content, materials, and data you create or upload to the Service (“Your Content”). By using the Service, you grant us a limited licence to host, store, display, and distribute Your Content solely for the purpose of operating and providing the Service.

AI-generated content

Courses created using our AI-powered tools are owned by you. You are responsible for reviewing and ensuring the accuracy of any AI-generated content before publishing.

Our intellectual property

The Service, including its design, features, code, and documentation, is owned by mycourse.work and protected by intellectual property laws. These Terms do not grant you any rights to our trademarks, logos, or branding.

Data and privacy

Your use of the Service is also governed by our Privacy Policy. Each organisation’s data is stored in a dedicated, isolated database and is not accessible by other organisations.

Availability and support

We strive to maintain high availability of the Service but do not guarantee uninterrupted or error-free operation. We may perform scheduled maintenance, deploy updates, or temporarily suspend the Service as needed.

Fees and payment

Certain features of the Service may require a paid subscription. If applicable, pricing, billing terms, and payment details will be presented at the time of purchase. All fees are non-refundable unless otherwise stated.

Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if required by law. Upon termination, your right to use the Service ceases, though provisions that by their nature should survive (such as intellectual property, limitation of liability, and governing law) will remain in effect.

Disclaimers

The Service and all content are provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.

Course content — whether created by users, organisations, or AI tools — is provided for educational purposes. We do not guarantee the accuracy, completeness, or suitability of any content for any specific purpose or regulatory requirement.

Limitation of liability

To the maximum extent permitted by law, mycourse.work and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, data, or goodwill, arising out of or in connection with your use of the Service.

Our total aggregate liability for any claims arising under these Terms shall not exceed the amount you paid us in the twelve months preceding the claim.

Indemnification

You agree to indemnify and hold harmless mycourse.work from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights.

Changes to these Terms

We may update these Terms from time to time. We will notify you of material changes by posting the updated Terms on this page and updating the effective date. Your continued use of the Service after changes are posted constitutes acceptance of the revised Terms.

Governing law

These Terms are governed by and construed in accordance with the laws of New Zealand, without regard to its conflict of law principles. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of New Zealand.
